01. Scope of Services & Contract Acceptance

By scheduling an appointment, submitting an online booking form via motospace.in, or consigning a vehicle at our Sevoke Road, Siliguri workshop, the customer ("Client") enters into a binding service agreement with MOTOSPACE Automotive Group ("Company").

The scope of work encompasses automotive paint restoration, paintless dent repair (PDR), OEM spray painting, TPU paint protection film (PPF) application, 9H ceramic coating, and custom performance modifications as specified in the agreed Job Card.

02. Vehicle Intake & Pre-Inspection Protocol

Prior to commencement of any repair or detailing work, an authorized MOTOSPACE service advisor and the Client shall conduct a thorough physical and photographic 40-Point Pre-Work Condition Inspection:

• All pre-existing scratches, stone chips, micro-dents, and clear-coat peeling will be logged on the digital Job Sheet and signed off by both parties.
• Clients are strictly required to remove all personal belongings, cash, toll tags, electronic gadgets, and valuables from the vehicle prior to drop-off. MOTOSPACE assumes no liability for unsecured items left inside the cabin.
• Fuel level and odometer readings are officially recorded upon vehicle check-in. Test drives are strictly restricted to quality-assurance calibration within a 5 km radius unless otherwise authorized.

03. Cost Estimates, Invoicing & Payment Terms

Written estimates provided after initial inspection are valid for fourteen (14) calendar days. Estimates represent our professional assessment based on visible damage; hidden internal panel corrosion or pre-existing filler failure will be notified with a revised supplemental estimate.

• Deposit Requirement: Full-body resprays, custom body-kit imports, and comprehensive PPF wraps require an upfront advance deposit of 40% to 50% upon Job Sheet signing.
• Final Settlement: The remaining balance is payable in full prior to vehicle release via UPI, Credit/Debit Card, Net Banking, or Bank Transfer. Vehicle keys and warranty certificates will only be released upon receipt of full payment.
• All commercial invoices are subject to applicable GST and statutory taxes as mandated by the Government of West Bengal and India.

04. Warranty Coverage: Paint & PPF Guarantee

MOTOSPACE takes pride in unmatched craftsmanship and provides formal written warranty coverage on qualifying services:

• Lifetime OEM Paint Warranty: Covers cracking, peeling, clear-coat blistering, and premature oxidation resulting from application defect or paint material failure for as long as you own the vehicle.
• PPF & Ceramic Guarantees: 5 to 10 Year TPU Film Warranty protects against yellowing, bubbling, peeling edges, and abnormal haze, subject to mandatory annual maintenance inspections.
• Warranty Exclusions: Warranty does not cover subsequent stone chips, acid rain etching, bird dropping burn-through left unwashed, accidental impacts, third-party repainting, or abrasive brush car washes.

05. Cancellations, Rescheduling & No-Show

Due to the limited throughput of our climate-controlled downdraft paint booth and master technicians' dedicated time slots:

• Appointments may be rescheduled or cancelled without penalty by providing at least 24 hours prior notice via phone or WhatsApp at +91 81700 05338.
• For custom paint mixing orders or imported body kit parts already ordered, deposit refunds are subject to deduction of direct procurement costs.

06. Vehicle Storage, Pick-up & Mechanic's Lien

Upon completion of service, the Client will receive a formal notification via SMS, call, or email confirming that the vehicle is ready for collection:

• Clients must inspect and collect their vehicle within forty-eight (48) hours of readiness notification.
• Vehicles uncollected after 48 hours without prior written arrangement may incur a secure garaging and storage charge of ₹500 per day.
• Pursuant to Section 170 of the Indian Contract Act, MOTOSPACE retains a statutory possessory lien over the vehicle until all authorized charges for work performed are paid in full.

07. Limitation of Liability & Force Majeure

MOTOSPACE maintains comprehensive garage keeper's liability insurance. However:

• The Company shall not be liable for delay, damage, or failure of performance arising from events beyond reasonable control ("Force Majeure"), including natural disasters, regional power grid failures, or severe supply chain disruptions.
• The Company's maximum cumulative liability under any circumstance shall not exceed the total amount paid by the Client for the specific service rendered on the disputed Job Card.

08. Governing Law & Grievance Contact

These terms shall be governed by and construed in accordance with the substantive laws of India. Any legal dispute or claim arising out of these terms shall fall under the exclusive jurisdiction of the competent courts in Siliguri, Darjeeling District, West Bengal.
